Legal Rights to the data obtained with Optitrack

Hello.
I have got a legal question.
I had a pleasure to work with the optitrack setup at a site of my ex-employer.
Currently the team, which I was a part of, have prepared an academic paper for publication. There is an intention to share with a research community a dataset, which was recorded with OptiTrack in my ex-employer's company.
Ex-employer is onboard with the publication of paper & dataset.

However, I notice the following clause in Optitrack's "Web Site Terms of Use":

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.
Is our dataset a "derivative work" of Optitrack software & hardware?
Or Are we enabled to share it with the academic community?
