Technically its not so hard to enable controls in freelook mode.
The only thing they need to do is to remove these lines from their scripts:
It seems they blocking it for the sake of gamepads.

So Im guessing that now that the patch is out for BF3 they told Natural Point to GET BENT. And that was the last hope for TIR support in Battlefail 3

Not necessarily. I still haven't heard back from their CTO on their final decision. Our fingers are still crossed, though at this point there's nothing left for us to do to persuade DICE one way or another.

Just wanted to say that I posted in another thread about a possible work-around to get this functioning in BF3:

Never heard back on whether it's possible through that method though, as I do not have a TrackIR myself (planning to buy one)

I used BF3 settings editor, and found if it DID work, it no longer does. Even the hidden "heavy brake" option seems to have been disabled as I couldn't get that to work either.

yeah I havent tried it since the patch.. was worried about that being the case :-/
hopefully the author updated the program or it is at least possible to re-implement some of that stuff. the perma-freelook stuff thats required to get this possibly working takes some steps to set up, like you have to select "mouse jet" and "mouse heli" on the last page but still bind the looking functions to your mouse and unbind them from everything else
