can I use VE if my unit is placed approx 12 inches below the brim of the hat and three feet away?

Yes. Just try and have it positioned so that the 3-dot pattern is pretty much in the centre of the tracking screen view.

In my case the receiver is not level either being on top of my 21" monitor and works fine.
